The Boyz’ 9 members win injunction application to suspend exclusive contract…“Confirmed lawful termination”

Among the 10 members of the group The Boyz (THE BOYZ) , nine won an injunction application they filed against their agency, OneHundredly Readable, seeking to suspend the effect of their exclusive contract, allowing them to pursue independent activities.

In an injunction ruling granted on the 24th, the nine members of The Boyz (Sangyeon, Jacob, Younghoon, Hyunjae, Juyeon, Kevin, Q, Sunwoo, and Eric)’s legal representative, Kim Moon-hee of the law firm Yulchon, said the previous day’s court decision upheld the artists’ request for an injunction to suspend the effect of the exclusive contract. Attorney Kim explained, “The court determined that the agency violated its obligation to pay settlement money, failed to fulfill its duty to provide settlement materials, and could not meet key responsibilities such as management support and protection. It was recognized that, due to the agency’s fault, the relationship of trust between the parties had reached a level that is difficult to restore, and therefore the exclusive contract was lawfully terminated.”

Rejection of the agency’s advance payment claim; background Meanwhile, OneHundredly Readable had argued through the injunction case procedure that the contract fee already paid to the members had the nature of an advance payment. However, the court explicitly rejected the claim, noting that the payment of the contract fee and the allocation of settlement money based on the generation of profits are set out in separate provisions. Previously, the nine members excluding New filed an injunction application in February, saying that the agency had failed to pay settlement funds starting in July of last year. Recently, they have also been embroiled in legal conflict after filing a complaint against OneHundredly Readable CEO Cha Gawon, alleging a violation of the Act on the Aggravated Punishment of Specific Economic Crimes (embezzlement).
