
The advertising production company Dolphin Kidnapping Group, which received a 1 billion won compensation ruling in the first trial for illegally posting the music video of NewJeans' 'ETA' on YouTube, has applied for a stay of enforcement.
According to the legal community on the 20th, Dolphin Kidnapping Group filed a request for a stay of enforcement regarding the provisional execution of the first trial ruling in the damage compensation lawsuit at the Seoul Central District Court.
On the 13th, the 62nd Civil Division of the Central District Court(Chief Judge Lee Hyun-seok)judged that the Dolphin Kidnapping Group and Director Shin Woo-seok, who produced NewJeans' 'ETA' music video, violated the contract by posting a director's edited version of the music video on their own YouTube channel, resulting in a partial victory for the plaintiff in the damage compensation lawsuit filed by Ador.
The court recognized 1 billion won of the 1.1 billion won damage compensation claimed by Ador, ruling that provisional execution is possible. This allows for the temporary enforcement of the compensation even if the ruling is not finalized.
The court may allow provisional execution for the swift realization of rights before the ruling is finalized, and in this case, the losing party can apply for a stay of enforcement along with an appeal.
The case for the stay of enforcement by Dolphin Kidnapping Group is being heard by the 63rd Civil Division of the same court(Chief Judge Lee Kyu-young).
