Attention is focused on whether the group NewJeans and its agency ADOR, which have been in conflict for 8 months over an exclusive contract dispute, can achieve a dramatic agreement through non-public mediation at the court on the 14th.
The 41st Civil Division of the Seoul Central District Court (Chief Judge Jeong Hoe-il) will hold a mediation session on the 14th afternoon regarding the lawsuit filed by ADOR to confirm the validity of the exclusive contract against the five members of NewJeans. The court decided to refer the case for mediation on July 24.
Background of the Court's Mediation Referral
The referral for mediation is a procedure that the court initiates when it deems it preferable to resolve the conflict between both parties amicably through compromise rather than a judgment. This is interpreted as the conflict between NewJeans and ADOR having complex aspects beyond a simple contract dispute, making a legal judgment alone insufficient for a fundamental resolution.
The court designated a non-public mediation date and required the direct attendance of NewJeans members. If the mediation fails, a ruling will be made on October 30.
Eight Months of Parallel Conflict
NewJeans and ADOR have been on a parallel path since the onset of the exclusive contract dispute. NewJeans has consistently maintained the position that "the trust relationship has collapsed, and we cannot continue the exclusive contract," while ADOR counters that "there are no grounds for terminating the exclusive contract."
The conflict between the two parties surfaced when NewJeans held an emergency press conference in November last year to notify ADOR of the termination of the exclusive contract. Subsequently, they declared their intention to engage in independent activities under the new activity name 'NJZ'.
ADOR's Legal Response and Victory
In response to NewJeans' unilateral termination notice, ADOR immediately took legal action. ADOR stated, "Claiming that trust has been unilaterally broken does not constitute grounds for termination," and filed a lawsuit for confirmation of the validity of the exclusive contract against NewJeans on December 3 last year.
On January 6 of this year, they also applied for an injunction to prohibit the preservation of agency status and the signing of advertising contracts. The court accepted ADOR's application for the injunction on March 21, ruling that NewJeans should not engage in independent activities.
NewJeans' Challenge and 1 Billion Won Fine
Despite the court's injunction decision, NewJeans members did not back down. They took to the stage at a concert in Hong Kong under the name NJZ, executing their intention for independent activities. In response, ADOR filed for indirect enforcement.
Indirect enforcement is an order to pay a certain amount based on the delayed period if the court's decision is not implemented. On May 29, the court accepted the indirect enforcement application, ruling that NewJeans should not engage in entertainment activities without ADOR's prior approval or consent until the first instance ruling on the exclusive contract is made.
In particular, the court also decided that if they violated this obligation and engaged in independent activities, each member would have to pay ADOR 1 billion won for each violation, strongly hindering NewJeans' independent activities.
Possibility of Successful Mediation and Variables
Opinions among industry insiders are divided on whether this mediation can succeed. Some believe that both sides are exhausted from the protracted conflict and may find a compromise, while others speculate that too much emotional rift has already developed, making agreement difficult.
Notably, the fact that NewJeans members will directly attend the mediation is significant. This is interpreted as the court's intention to hear the direct opinions of the parties and seek realistic solutions.
Impact on the K-Pop Industry
The conflict between NewJeans and ADOR is having a significant impact on the entire K-Pop industry, beyond just an individual case. Various issues such as the relationship between artists and agencies, the validity of exclusive contracts, and the limits of independent activities will be subject to legal judgment through this case.
Particularly, as this is a contract dispute involving a globally popular K-Pop group, international interest is also high. The outcome of this mediation is likely to set a precedent for similar cases in the future.
Fans' Concerns and Expectations
Fans of NewJeans hope that this mediation will resolve the conflict amicably, but at the same time, they want the members' will to be respected. With the ongoing conflict for 8 months, NewJeans' normal activities are being restricted, leading to increased worry and anxiety among fans.
Industry Attention
The K-Pop industry is closely watching the outcome of this mediation. If the mediation succeeds, there is high interest in what conditions the agreement will be reached, and if it fails, what judgment will come in the October ruling.
In particular, the court's final judgment on the validity of exclusive contracts and the rights of artists to engage in independent activities is expected to have a significant impact on contract practices across the industry.
Significance of Today's Mediation
The non-public mediation held on the 14th could be a crucial turning point in the conflict between NewJeans and ADOR. Attention is drawn to whether the two sides will achieve a dramatic agreement or continue the conflict until the October ruling.
Regardless of the outcome, this case is expected to leave an important precedent regarding contract relationships and artist rights in the K-Pop industry.
