Of the 10 members of the group THE BOYZ (THE BOYZ), nine were accepted in court for a provisional measures request to suspend the effect of their exclusive contract with their agency One Hundred Label. As a result, the members can carry out independent activities without the agency’s restrictions until a final ruling on the merits is issued.
■ Court: “Trust is shattered due to violations of key obligations”… Nine members rule in favor
According to the legal team at Yulchon (attorney Kim Moon-hee), which serves as the legal representative for the nine members of The Boyz, on the 24th, the Seoul Central District Court decided to grant the provisional measures request filed by the nine members the day before. The case involves the nine members excluding New, the member who decided to keep the exclusive contract, including Sangyeon, Jacob, Younghoon, Hyunjae, Juyeon, Kevin, Q, Sunwoo, and Eric.
The panel pointed out that the agency violated its duty to pay settlement money, failed to fulfill its duty to provide materials necessary to verify the appropriateness of the settlement, and did not do its duty regarding management support and artist protection. Based on this, the court determined that “due to the agency’s responsibility, the parties’ relationship of trust has reached a level that makes it difficult to restore.”
In particular, the agency argued that the contract deposit already paid is of the nature of an advance payment and denied the violation of settlement obligations, but the court did not accept the agency’s claim, noting that the contract deposit payment and revenue distribution are separate provisions.
■ One Hundred: “Legal distortion… Immediate filing of an objection and response to a lawsuit on the merits”
In response, the agency One Hundred Label expressed immediate regret and countered the claims. In an official position statement, the agency criticized that “granting the provisional measures is only a temporary measure until the final confirmation of the ruling on the merits, and the claim that the contract termination has been finalized is an obvious legal distortion.” It added that, “because the schedule is urgent, the agency’s core clarification materials were not reviewed sufficiently,” and emphasized that it will promptly file an objection and reveal the truth through a lawsuit on the merits.
■ The concert will go ahead as scheduled… “Keeping promises with fans comes first”
Even as the legal dispute intensifies, the nine members of The Boyz will carry out their scheduled solo concerts normally at the KSPO Dome at Olympic Park in Songpa-gu, Seoul, from today (the 24th) through the 26th, to keep their promises with their fans.
The legal representatives said, “We will take responsibility and do our best sincerely to keep our promises with fans only for schedules that were already confirmed before the termination of the exclusive contract, and to minimize any harm to third parties.” Earlier, members including Sunwoo and Younghoon directly refuted the agency’s claim of “settlement completed” through SNS, saying they “received nothing,” drawing attention to whether the members will speak up directly at this concert.
